This offence can be committed by a person's driving falling below the standard of a reasonable, prudent and competent driver. The standard is applied to all of the circumstances of the case. The prosecution do not have to show that the driver was conscious of the consequences of his or her actions but rather that they were merely conscious of what they were doing. Eating, smoking, drinking, applying make up, map reading and tuning the car stereo can all trigger a prosecution for this offence. Being inconsiderate to other road users or pedestrians can also be prosecuted. We can assist in persuading a Court that the driving may not have been a departure from the required standard when viewed objectively. The prosecution must show that a driver is at fault. |
